A statute concerning relocation called the Alabama Parent-Child Relationship Protection Act is an important example of why family law clients need to be fully informed. This act supports the general proposition that a child needs both parents in their life, even after a divorce. Thus, if a parent with primary custody of a child is planning on moving from their current residence, they must provide the non-custodial parent with advance notice of the move. The non-relocating parent must object within 30 days after notice or the move is deemed to be approved. Child Support Child support is calculated through the Alabama child support guidelines. In order to deviate from the amount awarded, there must be good reason shown for the departure upward or downward. If the child support award is to be modified at a later point, the petitioning party must demonstrate to the court that there has been a material change in circumstances.
